Buy or Pass? Terms of Use
Effective: November 6, 2026
These terms are an agreement between you and Jimmie Zinn ("I", "me"), the publisher of Buy or Pass?. By using the app you agree to them. If you got the app from the App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies, and these terms add to it.
What the app is
Buy or Pass? is a tool for resellers. It estimates eBay fees and profit, gives buy-or-pass verdicts, tracks inventory, sales, consignment, mileage and expenses, and can identify items from photos using AI.
Estimates, not guarantees
- Verdicts, profit, fees and "pay no more than" prices are estimates based on the numbers you enter and on eBay's published fees as I understand them. eBay can change its fees, and your real results will vary.
- AI identification and listing drafts can be wrong. Check the item, its tags and real sold listings before you buy or list.
- Tax reports and mileage figures are records to help you, not tax, legal or financial advice. Talk to a qualified tax professional about your situation.
You're responsible for your buying, pricing, listing and tax decisions.
Not affiliated with eBay
Buy or Pass? is an independent app. It isn't made, endorsed or sponsored by eBay Inc. "eBay" is a trademark of eBay Inc., used here only to describe what the app works with.
Buy or Pass? Pro
- Pro is an auto-renewing subscription: $7.99 a month or $59.99 a year in the US, or the local price shown in the store.
- Payment is charged to your Apple or Google account when you confirm the purchase.
- It renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the next period within 24 hours before it begins.
- Manage or cancel your subscription in your Apple or Google account settings. Canceling stops future renewals; you keep Pro until the end of the period you paid for.
- Refunds are handled by Apple or Google under their policies.
- Pro includes a monthly allowance of AI photo scans, shown in the app before you subscribe. The allowance resets each month.
- AI photo identification works only if you agree to send your photos to the AI provider, as described in the Privacy Policy. Pro's other features don't require that.
Fair use
Don't misuse the app or its server. That means no automated or bulk requests, no attempts to get around scan limits, no reverse engineering of the server, and no uploading of photos you don't have the right to use or that break the law. I may limit or block access that harms the service or other users.
Your content
Your records stay on your device and belong to you. When you use photo identification, you allow the app to send your chosen photos to its server and AI provider to produce your result, as described in the Privacy Policy.
Changes and availability
I may update the app, change or remove features, or update these terms. If a change is important, I'll note it in the app. I'll try to keep the AI service running, but it may sometimes be unavailable.
Disclaimer and limit of liability
The app is provided "as is," without warranties of any kind, to the extent the law allows. To the extent the law allows, I'm not liable for indirect or consequential losses, or for business losses such as lost profits or bad purchases, and my total liability to you is limited to the amount you paid for the app in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
Governing law
These terms are governed by the laws of the State of Kansas, USA, except where the law where you live says otherwise.
